SHIPPING and HANDLING

Most in-stock items will ship within 2 business days via USPS or UPS (except to P.O. boxes). Direct shipments from the manufacturer may require more time. We will do our best to inform you via email of any shipment delays. If an item is backordered, you may choose to wait or request a refund, credit or exchange. In the case of a mixed order of backorder and non-backorder items, non-backorder items will ship immediately and you will only be charged once for shipping.

Please note that in order to maintain our dedication to the environment we reuse boxes and packaging whenever possible. If new boxes and/or packaging is required, we will use recycled materials.

INTERNATIONAL ORDERS

Orders and shipments outside of the USA are not permitted at this time.

RETURNS

Products may be returned within 30 days of purchase if new, unused and in the original packaging. The customer will be responsible for return shipping unless the product is defective, in which case we will reimburse for return shipping via the most economical method available. In the case of an exchange, Eco Home Gear, LLC will pay for shipping of the replacement item back to the customer via the same method the original product was shipped.

To initiate a return, go to www.ecohomegear.com:

1. click on "go to cart" and login if required

2. click on "orders history"

3. click on the order which has the item(s) to be returned

4. click on "create return"

5. select the item you want to return, the reasons for the return, what you would like us to do, and add any comments as needed. Please be specific as possible.

6. click "create"

8. Please keep any tracking documentation from your shipment, as we are not responsible for items lost during the return shipping.

SHIPPING DAMAGE

If a product was damaged during shipping due to the shipping carrier's negligence, please do not ship the item back yourself. Please contact USPS or UPS directly to return the package to us.

PAYMENT

We accept Visa, Mastercard, American Express, and Discover. We do not accept debit or any form of check. All orders must be paid in full before shipment. Michigan sales tax is required on items shipped to Michigan residents.

PRIVACY POLICY

Eco Home Gear, LLC collects the following information from customers that order from the site: name, shipping address, billing address, e-mail address and credit card information. This information is collected in order to fulfill orders placed online.

The email and address may be used to send emails or newsletters notifying you of special offers and product updates. However, if at anytime you wish to stop receiving these updates, you may opt-out. By selecting the opt-out link, your name will be permanently removed from our mailing list unless you request mailings again in the future. Also, should you receive any promotions, newsletters, etc. via postal mail and would like to be removed from that list, simply e-mail us at customerservice@ecohomegear.com.

We will never rent, sell, or exchange any email address we receive. By signing up for Eco Home Gear, LLC emails, you will not be sent advertising or messaging from any other company, regardless of their affiliation with Eco Home Gear, LLC.

Users of the site can have access to the information that Eco Home Gear, LLC collects in the "My Account" section of the website and can correct any inaccuracies.

Security of Personal Information/ Credit Card Information

Providing a secure website is important for your trust in Eco Home Gear, LLC. We have installed encryption software conforming to the Secure Socket Layers (SSL) protocol to safeguard all of the information you send to us. Even if you decide to save your credit card information on the EHG website for future purchases, there is no risk because the numbers are never transmitted or stored as text.

If we decide to change our privacy policy, we will post those changes to this document. We reserve the right to modify this privacy statement at any time, so please review it frequently.

Product Information

Description: Products are described as accurately and appropriately as possible in order to ensure that a customer understands the product they are ordering.

Color: Colors are represented as realistically as possible, but color variations of product images or color swatches are outside of the control of Eco Home Gear, LLC because software, hardware and Internet connections can alter the appearance of colors. If you are unsatisfied with a product, your sole remedy will be to return the product to Eco Home Gear, LLC.

Corrections

While we make every effort to ensure the accuracy of product and price information, errors do occasionally occur. We reserve the right to correct any errors or inaccuracies at any time. We apologize for any inconvenience this may cause. If you are not completely satisfied with your purchase, you may return it for a refund.

Your Account

The user is responsible for maintaining the confidentiality of information that could be used to access your account such as user id and password, and the user agrees to accept all responsibility for all activities performed using your user id and password. Additionally, the user is responsible for restricting access to your computer and not using public computers to access your account.

The EHG website does carry products for children, but only sells those products to adults with credit cards. If you are under 18 you may use the EHG website only with the approval and active involvement of a parent or guardian.

Risk of Loss

All items purchased from Eco Home Gear, LLC are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Disclaimer and Limitation of Liability

THE MATERIALS AND INFORMATION YOU FIND ON EHG WEBSITE ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE EHG WEBSITE AND ANY IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, EXPECTATIONS OF PRIVACY OR NON-INFRINGEMENT.

This disclaimer applies to any damages or injury caused by any failure or performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, act of God, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action.

You specifically acknowledge that Eco Home Gear, LLC is not liable for your defamatory, offensive, infringing or illegal materials or conduct or that of third parties, and Eco Home Gear, LLC reserves the right to remove such materials from the EHG website without liability.

Under no circumstances, including, but not limited to, negligence, shall Eco Home Gear, LLC be liable for any special or consequential damages that result from the use of, or the inability to use, the materials in the EHG website, even if Eco Home Gear, LLC or a Eco Home Gear, LLC authorized representative has been advised of the possibility of such damages. Applicable Law and Contract Interpretation

Eco Home Gear, LLC's principal place of business is in Michigan, and Eco Home Gear, LLC operates the EHG website from its offices in Michigan. The laws of the State of Michigan apply to this Agreement, without regard to conflicts of laws principles. If any provision of this Agreement is ruled to be unlawful, void, or otherwise unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire Agreement between you and Eco Home Gear, LLC relating to the subject of the EHG website.

Indemnity

You agree to defend, indemnify, and hold harmless Eco Home Gear, LLC, its officers, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of the EHG website or your breach of the terms of this Agreement. Eco Home Gear, LLC shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

Dispute Resolution

Any dispute arising with respect to this Agreement shall be resolved by negotiation between the parties or, if necessary, by resort to an appropriate federal or state court located in Detroit, MIchigan. You expressly waive and are estopped from asserting any right to pursue any claim against Eco Home Gear, LLC relating to this Agreement in any forum or venue located outside of Detroit, Michigan, in the event of the filing of any such claim, you stipulate to the transfer of the filing to any appropriate or available forum or court in Detroit, Michigan, at Eco Home Gear, LLC's sole discretion.

The EHG website may provide links to other sites (i.e. advertisers, affiliate partners, strategic partners or others). We are not responsible for examining or evaluating, and we do not warrant the products or offerings of, any of these businesses or individuals or the accuracy or content of their websites. Eco Home Gear, LLC does not assume any responsibility or liability for the actions, product, and content of any such websites. Before you use any website you should review the applicable conditions of use and policies. The inclusion of a link in the EHG website does not imply Eco Home Gear, LLC's endorsement of the site. If you decide to access linked third-party websites, you do so at your own risk.

Ecohomegear.com obtains item photographs and ingredients from manufacturers. This sometimes includes taking the information directly from the items themselves, or from the label or packaging of the items. We do not investigate to determine if the information is accurate nor can we provide assurance that all data entry was done without error. If manufacturers change ingredients or other specifications, we cannot assure you that we will update the information on the EHG website. Accordingly, the information displayed on the EHG website is not guaranteed to be 100% accurate and the actual item should be considered the authoritative source of all information with respect to the item.
